Homosexuality is a crime? Hearing from today in Supreme Court

10 July :- The hearing will begin from Tuesday onwards before a Supreme Court bench on a petition filed in the case of homosexuality cases to be kept out of the box. There is a possibility of a decision about whether homosexuality should be kept in the framework of the crime. The Supreme Court had already dismissed the petition in this regard. Then a curative petition was filed. The court had then clarified that the petition will be heard before the tribunal.

The Bench comprising the judges was summoned by the Bench. According to this petition, the legal matter of the 377 section has been challenged. According to this ordinance, it would be considered a crime if two enlightened persons had unnatural relations with each other. In this case, punishment or life imprisonment has been provided for 10 years. However, the petition said that Article 377 is against the constitution.

The Supreme Court had upheld the life sentence for his historic decision on homosexuality on 11 September 2013. The Delhi High Court had put two persons out of the line of law to establish homosexual relations with their mutual consent. This order was deferred by the Supreme Court. After the curative petitions were filed, the Supreme Court had decided to hear it in an open court.

In a brief hearing in the Supreme Court, the Chief Justice had said that the matter was serious and it was related to the Constitution. Therefore, the matter should be heard in the matter of 5 judges’ bench. The judge said that a larger bench will be produced and the matter will be sent to the Constitution. Senior counsel Kapil Sibal had contended in the court that the petitioners filed a curative petition.
