06th Aug : News Express 24 :- In relation to granting constitutional status to the National Backward Classes Commission, the 123rd Constitution Amendment Bill will be present in the Rajya Sabha today after passing the Lok Sabha. Some amendments have been made in the bill on behalf of the government, in which the woman member has been included in the commission. At the same time, efforts have been made to remove the doubt of the opposition regarding the interference in the states’ rights.
Let me tell you that the government had become a victim of this bill when the amendment of the opposition passed on this bill in the Rajya Sabha last year. Therefore, the bill had to be re-arranged by the government on some revision.
In the Lok Sabha, this Constitution Amendment Bill was passed unanimously, but due to lack of adequate strength in the Rajya Sabha, the government may have to face difficulties. However, if the support of BJD and Samajwadi Party is received, then the bill can also be passed in the Rajya Sabha.
After the passage of this bill, the National Backward Classes Commission will be formed for socially and educationally backward classes. There will be one president, vice president and three other members in this commission. In this manner, the terms of service conditions and duration of appointment of Chairman, Vice President and other members shall be subject to the President. The Commission will have the power to determine its own process.
Let us tell you that the Backward Classes Commission constituted in 1993 had been working on the social and educational basis only to include backward castes in the list of backward classes or to exclude the earlier castes from the list.
Due to getting constitutional status after the passage of this bill, Article 342 (a) in the constitution can be given to the proposed Commission with equal rights to the Civil Court. This will give the Commission the right to redress the grievances of the backward classes.
